Agreement to Our Legal Terms

We are Ethical Media Group, LLC (“Company,” “we,” “us,” or “our”), a company registered in the United States.

We operate the digital platform Ethical Media (the “App”), as well as related services that refer or link to these legal terms (collectively, the “Services”).

By accessing or using the Services, you agree that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree with these terms, you are prohibited from using the Services and must discontinue use immediately.

We may revise these terms at any time. The updated version will be effective upon posting, and you agree to be bound by the updated terms by continuing to use the Services after such changes.

The Services are intended for users aged 13 and older. If you are under 18, you must use the Services only with parental or guardian consent.

Our Services

The information on the Services is not intended for use in jurisdictions where such use would violate laws or regulations. Users accessing the Services from outside the United States do so at their own risk and are responsible for compliance with local laws.

The Services are not designed to comply with regulations like HIPAA or FISMA. You may not use the Services in a way that would subject us to such compliance obligations.

User Representations

By using the Services, you affirm that:

You have the legal capacity to enter into these terms.
You are at least 13 years old.
You are not using automated scripts or bots to access the Services.
You will not use the Services for unlawful or unauthorized purposes.
All information you provide is accurate and up to date.

Purchases and Payment

If you make purchases through the Services (e.g., token purchases), you agree to provide current and accurate payment information. All payments are in U.S. dollars.

We reserve the right to change prices or cancel orders at our discretion. All purchases are final and non-refundable unless stated otherwise.

Cancellation

Software

If the Services include downloadable software, you are granted a limited license to install and use the software in accordance with these terms. All software is provided “as is” without warranty.

Prohibited Activities

You agree not to:

Violate any law or regulation.
Interfere with the security or performance of the Services.
Upload malicious content or spam.
Harass, threaten, or harm others.
Attempt to reverse-engineer the software or platform.

We reserve the right to suspend or terminate your access for violating any of the above.

User-Generated Content

You may submit comments, media, or other content through the Services. By doing so, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content across any media format.

You represent that you own or have rights to the content you submit and that it does not violate anyone else’s rights.

We reserve the right to moderate or remove content that violates these terms or is deemed inappropriate.

Mobile Application License

You are granted a limited license to download and use the Ethical Media App on your personal device. You may not reverse-engineer or use the App for unauthorized purposes.

Additional terms may apply depending on whether the App was downloaded from Apple or Google Play.

Advertisers

We may display ads on the platform. Advertisers are solely responsible for the content and legality of their advertisements.

Services Management

We reserve the right to monitor, restrict, or terminate access to the Services at our discretion to protect the platform and its users.

By using the Services, you agree to our Privacy Policy and consent to the collection, use, and processing of your data in the United States.

If you believe content on the Services infringes your copyright, please contact info@ethicalmedia.io to submit a takedown request.

Term and Termination

We may terminate your access to the Services at any time for violations of these terms or applicable law. You may not create a new account after termination without our written permission.

Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue the Services at any time without notice. We are not liable for any downtime or service interruption.

Governing Law

These terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Dispute Resolution

Any disputes will be resolved through binding arbitration in North Carolina. Class actions are not permitted. Exceptions apply for intellectual property enforcement or injunctive relief.

Disclaimer

The Services are provided “as is.” We disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and availability. Use at your own risk.

Limitation of Liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, or consequential damages. Our total liability will not exceed the amount paid to us in the 3 months prior to the dispute.

Indemnification

You agree to indemnify and hold Ethical Media Group harmless from any claims, damages, or legal expenses resulting from your use of the Services or breach of these terms.

User Data

You are responsible for backing up your own data. We are not liable for data loss or corruption.

Electronic Communications and Signatures

You consent to receive communications electronically and agree that electronic agreements are legally binding.

Miscellaneous

These terms constitute the entire agreement between you and Ethical Media Group. If any provision is found unenforceable, the remaining terms still apply. We may assign our rights under these terms without notice.
